A bill was just introduced in the Senate that could make it easier to properly classify IT employees and others working with computers as exempt from overtime pay. Who would be covered under the exemption?
The answer: Employees who work in a “computer or information technology occupation (including but not limited to, work related to computers, information systems, components, networks, software, hardware, databases, security, internet, intranet, or websites) as an analyst, programmer, engineer, designer, developer, administrator, or other similarly skilled worker.”
In addition, individuals who manage/supervise the work of others performing these duties would be exempt.
The bill, dubbed the Computer Professionals Update Act (CPU) would broaden the FLSA’s current computer employee exemption.
Even the primary duties for exemption would become boarder.
The bill just hit Congress, so don’t expect any movement on it until at least 2012.
